1. General information / Validity
These Terms & Conditions are the basis of all Crazy Factory's deliveries and services. Any alternative and/or additional agreements require the expressed written consent of Crazy Factory. Consent by email is sufficient.

2. Offering
All Crazy Factory's offerings shown on the www.crazy-factory.com website are non-binding and may change at any time. Minor variations and technical changes to our images or descriptions are possible.
The contract is established with the completion of the order process on the Crazy Factory website and the order confirmation by Crazy Factory via email or upon execution of the order by Crazy Factory.

3. Prices and payment terms
The prices stated on the Crazy Factory website at the time of ordering are applicable to the order. All prices stated are the final prices in the currency chosen by the customer and contain the value added tax required by law of currently 7.6 percent. Changes due to obvious pricing errors are reserved. Postage and packing are charged separately.
Crazy Factory accepts all payment methods offered within the order process of the Crazy Factory website. Customers choose their preferred payment method. Any (potential) additional costs arising from the chosen payment method (e.g. C.O.D. charge) will also be charged separately. Offsetting reciprocal demands is only permitted with the expressed written consent of Crazy Factory.

4. Delivery, delivery timings and shipping costs
The delivery of goods to the customer is executed by the third-party providers (delivery services) stated in the order process. Customers choose their preferred method of shipping. Shipping costs are visible to the customer within the shopping cart prior to placing the order. Goods that are in stock will be shipped within two working days of receipt of the order.
Shipping of goods that are not in stock may take place up to two weeks from the receipt of the order. Crazy Factory's ability to ship goods is dependent on receipt of its own supplies. Should delivery fail due to reasons beyond Crazy Factory's control, Crazy Factory may withdraw from the contract. If this situation arises Crazy Factory is obligated to inform the customer in good time. Any payments made will be refunded without delay. In this case the customer has no right for compensation. Part deliveries are permissible insofar as the customer has not shown disinterest in receiving part deliveries or it is not obvious that they are unacceptable. In this case postage and packing will only be charged once.

5. Information about the right to exchange or return
All items bought from Crazy Factory can be returned within two weeks of receipt of the goods without giving any reason. This term begins at the earliest on receipt of the item and this information. Timely dispatch of the item is sufficient to comply with this period.
The right to return does not apply to items as part of a special order that have been manufactured specifically for this order. Payments made by the contractual partner will be refunded within 5 working days after receipt of the returned items by bank transfer and to an account to be specified by the customer. Any returns must be sent to the company address stated above.
The cost and risk of the return is carried by the customer. The returned item must carry sufficient postage. Should Crazy Factory incur additional costs due to insufficient postage paid for the return, these costs will be offset against any payments made by the customer.
Crazy Factory retains the express right to compensation for any damaged items. Should the customer be responsible for any deterioration, loss or other inability, he or she must replace the loss of value. Return of the item must be in its original packaging. Should this not be the case the customer must supply packaging which ensures that there will be no damage to the item. The customer will be liable for damages due to inadequate packaging.
Any obvious faults (in particular damages, incorrect deliveries or quantity variances), shipping damages or other faults must be reported to Crazy Factory immediately in writing, at the latest, however, within a period of 14 calendar days from receipt of items. Notification by email to info@crazy-factory.com is sufficient.

6 Transfer of risk
Delivery of goods is at the risk of the customer. The risk transfers to the customer with the supply of the goods to the shipping company. This is also applicable if Crazy Factory has paid for the shipping costs. Complaints about damages from transportation (e.g. damaged packaging upon receipt of the goods) must be indicated by the customer to the shipping company within the appropriate notice periods.

7. Warranty
Crazy Factory guarantees that the sold items are free from material or production faults and fulfil the contractually warranted properties at the point of risk transfer to the customer. The legally required warranty period of two years from the billing date is applicable. The warranty does not apply to regular wear and tear.
Customer claims for compensation, e.g. for non-compliance, culpa in contrahendo, violation of secondary contractual obligations, consequential harm caused by a defect, damages resulting from the unauthorised use and other legal grounds are not permissible. Excluded from this Crazy Factory is liable for the intentional or grossly negligent absence of any warranted properties. Claims according to the Product Liability Act are not affected.
Should any faults arise for which Crazy Factory is liable and where the exchanged item is also faulty, the customer has the right to conversion or reduction. Crazy Factory can neither be held responsible for a constant and continuous availability of www.crazy-factory.com nor for any technical or electronic errors in the online offering.

8. Retention of title
All deliveries are made with the retention of title. The delivered goods remain the property of Crazy Factory until such time as full payment for the goods has been made.

9. Data storage / data protection
We notify you that the data shared as part of the business transaction is processed and saved in an electronic file. All personal details submitted by the customer will be treated confidentially. Only for the purpose of order processing (payment, shipment) is the necessary data used in conjunction with third parties. You can request information about your saved data at any time and free of charge. To do so, please send an email to info@crazy-factory.com. For data protection reasons we can only reply to your request to the email address registered with Crazy Factory.

10. Jurisdiction
Jurisdiction for all disputes relating to the delivery is, where reconcilable, the jurisdiction of Crazy Factory. Crazy Factory's registered address is agreed upon as the place of jurisdiction in the case that the contractual partner has no place of jurisdiction in Switzerland or the contractual partner has moved their place of residence abroad after entering the contract or the place of residence of the contractual partner is unknown at the time of filing the complaint.
The contractual partners agree for the privity of this contract the application of Swiss confederate law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

12. Supplementary provision
The invalidity or ineffectiveness of single provisions of these Terms & Conditions do not affect the validity of the remaining conditions. Invalid or ineffective conditions are replaced by
statutory provisions.
